Free zone

Also known as: free trade zone · free zone company

Definition

A free zone is a UAE business zone with its own authority and licensing rules, separate from the mainland licensing of its emirate. For marketers, the licence location can decide which data protection law applies.

Free zones differ widely, so 'free zone rules' isn't one rule set. The clearest marketing consequence is data protection. The DIFC has its own Data Protection Law, DIFC Law No. 5 of 2020, which applies inside the DIFC and not on the mainland. ADGM has its own Data Protection Regulations 2021, under which its Commissioner of Data Protection can impose administrative fines of up to USD 28 million, a maximum rather than a typical penalty. DLA Piper noted in January 2025 that the federal PDPL leaves those separate laws in place.

A free zone licence doesn't step outside UAE advertising rules either. Reed Smith says the Cabinet decision on media content penalties applies both onshore and in free zones. For a business licensed in a free zone, the practical step is to find out which authority covers its data and its activities, and to check that the licence covers the trade it advertises. This isn't legal advice.
